Lawsuit Alleges IRS Denied Deduction For Fertility Treatments Because Being Gay Is A 'Choice'

Joseph F. Morrissey has filed suit against the Internal Revenue Service (IRS) in federal court after he was denied a tax deduction for medical expenses he incurred while trying to have a family. Since Morrissey is gay, he engaged the services of a surrogate who underwent in vitro fertilization (IVF) treatments. Those expenses, claims IRS, are not deductible. Morrissey disagrees.
